Subject: Special Campaign for Deemed Conveyance from 1st January 2021 to 15th January 2021

Sir,

There are 1,11,554 co-operative housing societies in the state as on 31/03/2020.

As per the provisions of Maharashtra Ownership Flats Act, 1963, it is mandatory for the developer to transfer the building and land in the name of the society within 4 months after the registration of the housing co-operative society. As long as the land under the building is not owned by the housing Societies, the Society has to rely entirely on the developer for the increased floor space index, building Redevelopment, etc.

For this purpose, the Government has appointed the District Deputy Registrar as the Competent Authority as per Government Notification dated 25 February, 2011, under Sections 5, 10 and 11 of the Maharashtra Flats Ownership Act, 1963 for Deemed Conveyance. Also, the number of documents to be submitted by the co-operative housing societies for this process has been reduced by the government decision dated 22nd June 2018.

In order to get the ownership of the land to the Co-operative Housing Society, a special drive is being carried out through the Commissioner for cooperation and the Registrar of Co-operative Societies, State of Maharashtra, Pune from 1st January 2021 to 15th January 2021 for Deemed Conveyance. The campaign aims to provide legal rights of the land from the developer to the concerned co-operative housing societies.

Your housing society which is under the jurisdiction of the District Deputy Registrar, Co-operative Societies and Competent authorities should submit the application for Deemed Conveyance to that office in the prescribed format along with the required documents. The concerned competent authority will hear all the parties involved in the case and issue a certificate at the end of the appropriate decision regarding the issuance of the Deemed Conveyance certificate.

Through this special campaign, efforts are being made so that all the co-operative housing societies in Maharashtra get their legal rights to their land from the developer. Building is of Society, ownership of land also belongs to Society only, according to this you should take active part in this special campaign and make the campaign a success.
